BASIC REQUIREMENTS
For EB-1C VISA

To obtain an EB-1C in the U.S., the following conditions must be met:

work experience of 1 year

The foreign national has worked in a foreign company in a management position for at least 1 year in the last 3 years.

continued work

The foreign national will continue to work for the U.S. company in a management position after entering the country.

operating company

The American company has been active for more than 1 year.

In addition to the above requirements,

the U.S. company and the foreign company must be

connected in one of the following ways:

Parent or subsidiary company

A U.S. company is a parent or subsidiary of a foreign company. The parent company must own more than 51% of the stock or interest of the subsidiary.

A division of an overseas company

The overseas company opens a division in the United States and continues its current operations.

Affiliated companies

A situation in which a controlling interest or stock in a U.S. and foreign company is owned by a third party (the same company, the same person, or the same group of persons).

In addition, the U.S. company must have sufficient funds to pay a decent salary to a foreign national who is transferred to a senior position in the United States.

WHAT IS THE PROCEDURE FOR SUBMITTING
PETITION FOR EB-1C VISA?

To obtain an EB-1C in the U.S., the following conditions must be met:

Step 1.

A U.S. employer files an EB-1C visa petition for a foreign worker with the U.S. Immigration Department.

Step 2.

After the petition is approved by the U.S. Immigration Department, the foreign national is interviewed at the U.S. Consulate in his or her home country.

Important!

If the foreign national is in the U.S. at the time the petition is filed, he or she must have legal immigration status throughout the pendency of the application.
