GENERAL REQUIREMENTS
FOR L-1 VISA APPLICATION

A foreign company that has sent an employee to the U.S. must continue to operate for the duration of the employee's L-1 visa.

Manager's visa

A manager visa is issued for 1 year (if the U.S. company has been in existence for less than a year) or 3 years (if the U.S. company has been in existence for more than a year).

Maximum term

The maximum period of stay in the USA for specialists is 5 years, for managers and executives - 7 years.

Employees

There is one unspoken requirement to obtain an L-1 visa for its employee. The U.S. company is strongly encouraged to demonstrate that it will employ 7 to 10 U.S. residents or citizens.

Parent or subsidiary company

A U.S. company is a parent or subsidiary of a foreign company. The parent company must own more than 51% of the stock or interest of the subsidiary.

A situation in which a controlling interest or stock in a U.S. and foreign company is owned by a third party (the same company, the same person, or the same group of persons).

An L-1 visa can be obtained by a worker who:

work experience

At least ONE YEAR in the last THREE YEARS has worked for a foreign company that sends him or her to the U.S.

position

Transferred to a U.S. company as a supervisor, manager, or lead specialist.

LIMITATIONS
WHAT ARE THE RESTRICTIONS ON THIS VISA?
An employee may only work for the company to which he or she has been transferred.
The visa is initially issued for 1 year if the U.S. company has been in existence for less than a year and for 3 years if the U.S. company has been in existence for more than a year: - The worker will then need to apply for a visa extension; - It is possible to extend the visa without leaving the US. However, if the worker obtains a residence permit, he or she can stay in the U.S. permanently with the right to apply for citizenship.
U.S. residency is limited to 5 years for professionals and 7 years for managers or executives.

The foreign company must continue to operate and remain profitable as long as the executive, manager, or lead professional is in the U.S. in L-1 status.

However, if the U.S. company petitions for residency for an employee who is in L-1 status and the petition is approved, the maintenance of the foreign company will be optional.
