To obtain EB-5 in the U.S., you must meet

THE LEGALITY OF CAPITAL?

To obtain an EB-5 visa, the investor must prove the legitimacy of the

origin of the invested funds.

EB-5 VISA FOR THE WHOLE FAMILY

The US investment visa has the great advantage of being able to choose which family member to petition for. We are talking about spouses and minor children over the age of 14. At the same time, the Green Card can be issued only for those family members who want to receive it.

To illustrate, let's look at two situations.

Example 1:

Spouse does not wish to obtain a Green Card in the U.S., but would like his spouse and children to receive one. The EB-5 VISA allows you to petition on behalf of the spouse, after which she and her children under age 21 will receive a U.S. Green Card, but the spouse will not.

Example 2:

Spouse and spouse do not wish to receive Green Cards, but would like the child to receive one. EB-5 VISA in the U.S. allows for a petition to be filed on behalf of the child, after which the child will receive an EB-5 VISA. In this case, the source of investment can be money gifted by the parents.

If the child immigrates to the U.S. and lives there for 5 years, he or she will be able to apply for U.S. citizenship. And after obtaining the latter, he or she will be able to petition for family reunification, which will allow his or her parents to obtain a Green Card in the shortest possible time.

Important! If there are multiple children in the family and the petition is filed by one of the children, the other children will need to file separate petitions (i.e., they will need to make an investment for each child). If one parent is the Petitioner, all children will obtain U.S. residency through the parent.

HOW SOON AFTER INVESTING IS A GREEN CARD ISSUED?

Currently, it takes one to two years to process an EB-5 visa petition in the United States. If the decision is favorable, the applicant is issued a Green Card for 2 years. Prior to the expiration of this period, an application to remove the conditional Green Card status must be filed. If the application is approved, the applicant will receive a permanent Green Card for 10 years.

An applicant may file a petition for an EB-5 immigrant visa from the United States together with an application for work authorization and entry/exit from the United States. This will allow the Applicant to begin residing in the U.S. in lawful status and with the right to work and travel immediately, rather than waiting for final approval of the petition.

TO COME TO THE U.S. AFTER FILING A PETITION

An Applicant may petition for an EB-5 immigrant visa from outside the United States, but later come to the United States and apply for work authorization and entry/exit from the United States. This would allow the Applicant to continue to reside in the U.S. in lawful status and with the right to work and travel.

What types of investment visas are there?

There are two main types of investment visas: the EB-5 visa and the E-2 visa. 

The minimum investment for an EB-5 visa is $800,000, while for an E-2 visa, it is recommended to invest more than $100,000. Although the investment amount for an E-2 visa is significantly less than for an EB-5 visa, the E-2 visa is not available to citizens of certain countries. Citizens of these countries often obtain citizenship in another country (e.g., Grenada) and apply for an E-2 visa from Grenada.

Which investment visas are immigrant visas?

The EB-5 visa is an immigrant visa; this means that by obtaining an EB-5 visa, you are granted residency (green card) in the United States. The E-2 visa is not an immigrant visa, so it only gives you the right to live and work in the U.S. for as long as your U.S. business exists.

What are the main U.S. business visas?

Can I petition for an EB-5 visa on behalf of a spouse or child so that I do not need to obtain a U.S. residence permit (green card) myself?

Yes. You can gift the funds needed for the investment to your spouse or child (usually over the age of 14) to make the investment. In this case, they may not include you in their EB-5 visa petition, which will result in you not receiving a U.S. residence permit.

Can forming a U.S. company help me get a visa?

Yes, in some cases. Certain U.S. visas are designed for entrepreneurs and investors. For example:
